A person can get a Montane POA if they are over 18 years of age and are of sound mind.
Being of sound mind, or having ‘mental capacity’, is the ability to make and be held by legal decisions. There are a range of events and circumstances that can temporarily or chronically prohibit capacity, including:
- psychiatric conditions
- genetic conditions (eg. Down’s Syndrome)
- degenerative conditions (eg. Alzheimer’s Disease)
- effects of severe stroke
- effects of drugs, either medicinal or otherwise
- effects of advanced age
- brain damage or unconsciousness induced by accident or trauma.
