Understand registered interests
When you receive your TitleSafe report, you may notice the Current Title Search displays registered interests. Learn more about how some registered interests may restrict your choices about your property.
Types of registered interests
An interest describes any right or claim a person has towards real property. The law recognises the interests of the person or people who own a property and who have a registered interest.
There are also other interests held by people who don’t possess the property, but have some say over how the property can be used and whether or not it can be sold. This is called a registered interest. For example, a registered mortgage or a caveat.
About registered mortgages
There may be registered mortgages on your Title that have since been paid out. Without the release of the old mortgage by the lender, the property cannot be sold or transferred.
About caveats
A caveat is a way someone can register on your Title their interest in the property. You cannot sell or transfer ownership of the property while there is a registered caveat on Title.
