Learn more about who can buy a Montane Health Directive.
A person can get a Montane Health Directive if they are over 18 years of age and are of sound mind.
Being of sound mind and having mental capacity is the ability to make and be held by legal decisions. There are a range of events and circumstances that can temporarily or chronically prohibit capacity, including:
- psychiatric conditions
- genetic conditions (eg. Down’s Syndrome)
- degenerative conditions (eg. Alzheimer’s Disease)
- effects of severe stroke
- effects of drugs, either medicinal or otherwise
- effects of advanced age
- brain damage or unconsciousness induced by accident or trauma.
Without capacity, you cannot make any Montane Legal document, including Montane Health Directive. If you are unsure about whether you or a loved one has capacity, get help here.
